Sterling Breeze Resort Rules & Regulations

Sterling Breeze is a premier vacation spot! Maxet Management Company and the Sterling Breeze Condominium Owners Association, Inc., would like to ensure everyone has an amazing time while visiting Sterling Breeze. Please respect the rules outlined below.

NOTE: All rules below apply to owners and guests.

Members are responsible for the actions of their guests at all times. Owners are subject to any fines their guests receive. Management will post in MGC and notify Owners/Members within 48 hours of a violation issued against their unit.

1. ARMBANDS/WRISTBANDS: Armbands/Wristbands are required to enter the pool area from the building or beach. Refusal to show staff armbands/wristbands will result in access to the pool being denied. (This rule will be enforced March 1st – October 31st). Broken armbands/wristbands will be replaced at no cost if the damaged band is returned to the Concierge Desk. Lost armbands are subject to a replacement fee, as set by the Board of the Association from time to time.

2. POOL AND SPA: No lifeguard present swim at your own risk:
a. Pool hours: 9 am to 10 pm: No person shall enter the pool when the pool is closed.
b. Pool is closed during inclement weather. Any person refusing to exit the pool or spa when asked to do so by a staff member due to bad weather or lighting is subject to ejection from the pool.
c. No Diving/Dangerous Behavior. Anyone that has been warned and continues unsafe conduct in the opinion of a staff member will be asked to exit the pool and/or spa at once.
d. No Beverages of any kind within 4 ft of the pool or spa. Spillage can cause the pool to close! In the event there are costs associated with cleaning a spill, said cost will be assessed to the Owner. (In accordance with Florida FAC 64E-9.008)
e. No personal broadcasting of music or audio is allowed on the pool deck. Personal headphones must be used at all times. NOTE: The wine bar may be allowed to broadcast music or audio.
f. NO Glass on the pool deck.
g. No Coolers within 4 feet of the pool or impeding walkways.
h. No large floats or any items such as surfboards, body boards, footballs, large balls, or anything which creates an unsafe environment are allowed in the pool. Swim aids are allowed. Pool noodles and other devices used as a part of an event approved by the Association (i.e. water aerobics) are permitted.
i. No animals in the pool. Emotional Support Animals are not permitted around the pool area.
j. All children 16 years of age and under must be accompanied by an adult. No children under the age of 12 are allowed in the hot tub without the supervision of an adult. (FAC 64-E 6.0008.CDC highly recommends rules not allowing children under the age of 5 to be in a commercial spa)
k. Children under the age of 3 (or any person not toilet trained) must wear swim diapers.
l. Repeat offenders of pool rules may be subject to removal from the pool area.

3. FIRE PIT: Closes at 10 PM.

4. NO SMOKING/VAPING: No smoking or vaping is allowed in common areas, this includes legal or illegal smoking. If you are smoking or are in possession of any illegal substance in the Sterling Breeze building common areas, you may be ejected immediately and/or referred to the police, including balconies, pool, deck parking garage, or any area located on the building premises. Smoking in stairwells is prohibited. If you smoke on the beach, please be mindful and put all cigarette/cigar butts in the trash to protect the wildlife and to keep our beaches clean. This section is intended to be in accordance with Florida Clean Air Act – 386.206, Florida Statutes.

5. NO LOUD MUSIC/DISTURBANCES
a. Quiet Hours: Observed from 10:00pm to 9:00 am. Any loud music complaints during quiet time, after one warning, will be subject to a fine. Police called to a unit concerning disturbance, fighting or any other violations requiring police action are subject to ejection.
b. Construction Times: Construction is permitted between 8am – 7pm on Monday through Saturday.

6. FIRE
a. NO charcoal grills, flammable material, propane grills or open flames are allowed on the balconies. Permanently mounted electric grills are allowed.
b. Tampering of the fire system may subject the occupant to ejection, plus any repair(s) costs.

7. TRASH
a. Trash chutes are located on the west end of each of the floors, for normal bagged household trash only.
b. All commercial trash or material must be removed from the facility by the contractor and disposed of off-site.
c. No oversized objects or boxes of any kind are allowed to be disposed of in the trash chutes. For oversized objects, dispose of in the trash bins on the west side of the building located on the ground floor.

8. BALCONIES AND BREEZEWAYS
a. Nothing shall be dropped, thrown, swept, or otherwise expelled from any window, door, balcony or terrace. Railings are not to be used for hanging towels, bathing suits, clothes or other items.
b. Fire Code Regulations Prohibit any item left outside of a unit that impedes the walkway or Breezeway.

9. PARKING
a. A parking pass is required for each vehicle and can be purchased at the Concierge’s Desk. Fees may be subject to change without notice. Anyone that refuses to comply, may have their vehicle towed at the owner’s expense without notice. Parking Passes must always be visible in the front windshield of each vehicle.
b. No rental golf carts, mini cars, mopeds, or the like are permitted.
c. Owners may have a registered golf cart to be parked on the lowest level (parking allowed in the gravel area)
d. One shall not occupy two (2) parking spaces with one vehicle. Each occupied spot needs to have a separately purchased Parking Pass, maximum of 2 spots per condo. A third spot may be allowed by the concierge based on occupancy and availability.
e. No long-term parking in the front lobby pass through drive. Possible tow away at owner’s expense.
f. The front drive is for loading and unloading only, 10-minute limit.
g. All Unauthorized Vehicles will be towed at the owner’s expense. See condo declarations for additional vehicle rules.
h. Sterling Breeze cannot guarantee that members of the public will not enter the garage or building causing damage to property and/or engaging in criminal activity. Accordingly, park your vehicle in the garage at your own risk. Sterling Breeze is not responsible for the vandalism or any form of damage to vehicles incurred on the premises.

10. PRIVATE TENTS: It’s prohibited for guests/owners to place, maintain, or use any private tents in the area between the lounge chairs and umbrellas rented by the Sterling Breeze beach service and the waters of the Gulf of Mexico.

11. ABUSIVE BEHAVIOR: Any person(s) that is verbally or physically abusive to employees, COA officers, guests, owners or anyone on the property will be fined. If the offense happens in a common area, the offender(s) will be asked to leave the common area. Failure to leave the area can result in the police being called to the property and a disorderly conduct charge being issued.
Violence and/or aggression of any kind will not be tolerated and may result in the police being called to the property and/or immediate ejection without a refund.

12. WEAPONS: Weapons are not permitted on the grounds and possession of a weapon will not be tolerated and may result in the police being called to the property and/or immediate ejection without refund.

13. ELEVATORS: Jumping in the Elevator may cause the elevator to suddenly stop operating. The offending party will be responsible for repairs and may be trapped in the elevator for an extended period of time. Damaging, altering, or covering the camera in the elevator is subject to possible ejection plus repair costs.

14. DAMAGE TO COMMON ELEMENT(S): Intentional damage to the building, common elements, or fixtures including cameras is subject to possible ejection plus repair costs.

15. PETS: Guests are prohibited from having pets on the property.Owners need to refer to the SB condo declarations for additional pet rules.

16. LUGGAGE CARTS: Luggage carts are available for everyone to use. DO NOT take luggage carts inside your unit. RETURN luggage carts after each use.

17. LOSS OR THEFT: Sterling Breeze Condominium assumes no responsibility for any loss or of personal property.

19. EJECTION: If you are evicted from the unit you are renting for failure to abide by Sterling Breeze Rules and Regulations or for any other reason, you will not be entitled to a refund of the rents paid in advance. YOU WILL BE RESPONSIBLE FOR DAMAGES to the unit and/or common property caused by you or your guests.

20. NON-COMPLIANCE: The building rules apply to all guests and all owners, with no exceptions. Any owner that does not comply with the Sterling Breeze building rules will incur a fine per day up to $1000 per year. Any guest that does not comply may be evicted without a refund. All fines are subject to review by the Fine Committee and approved by the Condo Board of Directors. See Fine Committee and Long Rules Form for additional information.

21. STORAGE/CHARGING OF INDIVIDUAL ELECTRIC TRANSPORTATION IS PROHIBITED: Individual electric transportation, categorized as bike, scooter, or any other type of individual electric transportation is prohibited from being stored and/or charged in the building and/or in units to ensure safety. In the event of a fire or explosion, a battery fire requires a specialized fire retardant that may or may not be available to the firefighters. Electric transportation can be stored at the bike rack located in the parking garage. This provision does not apply to electric cars parked or kept in the association’s normal parking areas.
